1. Acceptance of Terms

By using Luminary and Luminary Premium (the "Bot"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Bot or its services.

2. Description of Service

Luminary is a Discord bot that provides moderation, logging, giveaways, and other features to Discord servers. Premium features may be available for a fee. The Bot is provided "as is" and may be updated, modified, or discontinued at any time without notice.

3. User Responsibilities

  • You must comply with Discord's Terms of Service and Community Guidelines.
  • You must not use the Bot for illegal, harmful, or abusive purposes, including but not limited to harassment, spam, or distribution of malware.
  • You are responsible for managing permissions and access to the Bot in your server.
  • You must not attempt to reverse engineer, decompile, or otherwise tamper with the Bot or its code.
  • You must not use the Bot to violate any applicable laws or regulations.
  • You are responsible for the actions of users in your server as they pertain to the Bot.

4. Data Collection & Privacy

  • The Bot may collect and store data such as server IDs, user IDs, moderation logs, command usage, and configuration settings for the purpose of providing its services.
  • Personal information is not collected unless explicitly provided by the user (e.g., for support or premium features).
  • Data is not sold or shared with third parties except as required by law, for the operation of the Bot, or with payment processors for premium features.
  • Data may be shared with Discord if required for moderation or abuse reports.
  • We implement reasonable security measures to protect your data, but no method is 100% secure.

5. Premium Features

  • Premium features may require payment. By purchasing, you agree to the terms of sale and any additional terms provided at the time of purchase.
  • Premium access may be revoked for violation of these Terms or abuse of the service.
  • No refunds are provided except where required by law.
  • Premium features may be subject to additional terms and conditions.

6. Limitation of Liability

  • The Bot is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any damages, losses, or issues arising from the use or inability to use the Bot, including but not limited to data loss, downtime, or server disruptions.
  • We are not responsible for the actions of third parties or other users.
  • We reserve the right to modify, suspend, or discontinue the Bot at any time without notice.

7. Compliance & Legal

  • The Bot is intended for use in compliance with all applicable laws, including but not limited to GDPR, CCPA, and DMCA.
  • Users are responsible for ensuring their use of the Bot complies with all relevant laws and regulations in their jurisdiction.
  • We will cooperate with law enforcement as required by law.

8. Dispute Resolution

  • Any disputes arising from the use of the Bot will be resolved through binding arbitration, except where prohibited by law.
  • By using the Bot, you waive your right to participate in class action lawsuits or class-wide arbitration.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Bot after changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms regularly.
